These Terms of Use govern your access to and use of the Nomly website, mobile application, and related services. By using Nomly, you agree to these Terms. If you do not agree, do not use the service.

Use of the service

You may use Nomly only in compliance with applicable law and these Terms. You are responsible for activity carried out through your account or device, and for keeping your access credentials and devices reasonably secure.

Acceptable use

You agree not to:

  • Use Nomly in a way that violates law, regulation, or the rights of others.
  • Interfere with the service, disrupt infrastructure, or attempt unauthorized access.
  • Reverse engineer, copy, scrape, or exploit the service except as permitted by applicable law.
  • Use Nomly to transmit harmful code, abuse platform features, or engage in fraudulent behavior.
  • Misrepresent your identity, entitlement status, or relationship with Nomly.

Accounts and availability

Some features may require an account, a supported device, internet access, or a current version of the app. We may modify, suspend, or discontinue all or part of the service at any time, including features, limits, availability, and supported regions, with or without notice where allowed by law.

Premium or Pro subscriptions

Nomly may offer optional paid features through a Premium or Pro subscription. Subscription scope, pricing, billing period, included features, and any promotional terms will be shown to you at the time of purchase.

On iPhone, subscriptions are purchased through Apple's in-app purchase system. Apple is the merchant of record for those purchases and handles payment processing, billing, renewals, cancellations, and any refund requests under Apple's applicable terms and policies.

RevenueCat may be used by Nomly as a technical subscription management provider to validate purchase status, determine entitlements, and help deliver paid access. RevenueCat does not replace Apple's billing terms, and your purchase remains subject to the App Store rules and the terms presented by Apple at checkout.

Automatic renewal, cancellation, and refunds

Unless otherwise disclosed at the time of purchase, subscriptions may renew automatically until canceled. If your subscription is handled through Apple, you must manage cancellation through your Apple account or App Store subscription settings.

Nomly does not control Apple's billing systems and generally cannot directly cancel, refund, or reverse an in-app purchase processed by Apple. Refunds, credits, charge issues, and renewal disputes for Apple-based subscriptions are subject to Apple's policies and processes.

If a trial, introductory offer, discount, or promotional period is made available, the terms of that offer will be shown at the time of activation and may be governed by Apple's rules where applicable.

Subscription access and changes

Access to Premium or Pro features may be limited, suspended, or terminated if payment fails, a subscription expires, Apple reports a billing issue, a purchase is refunded or revoked, or misuse of the service is reasonably suspected.

We may change subscription features, capacity limits, packaging, pricing structure, or availability from time to time. Changes will not retroactively alter obligations already completed, but future renewals or new purchases may be subject to the pricing and terms then in effect, subject to applicable law and platform rules.

Intellectual property

Nomly, including its software, branding, design, content, and related materials, is protected by intellectual property laws. Except for limited rights to use the service under these Terms, no rights are granted to you.

User content

You retain rights in the content you create or submit to Nomly, subject to any rights needed by us to host, process, back up, transmit, display, and operate the service. You are responsible for ensuring you have the rights needed for any content you upload or store through the service.

Disclaimers

Nomly is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee uninterrupted availability, absolute accuracy, or that the service will always be free of defects, delays, or security incidents.

Limitation of liability

To the maximum extent permitted by law, Nomly and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, profits, goodwill, or business opportunities arising out of or related to your use of the service.

Termination

We may suspend or terminate access to the service if we reasonably believe you have violated these Terms, created risk for users or the service, or where suspension is necessary for legal, operational, or security reasons.

Changes to these Terms

We may revise these Terms from time to time. If we do, we may update the date above and provide notice by reasonable means where appropriate. Continued use of the service after updated Terms become effective means you accept the revised Terms.
